Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and SurveyMitra, operated by Ankit Izardar, Indore, Madhya Pradesh, India. By accessing or using surveymitra.com — whether to book a survey appointment, register as a surveyor, or browse the platform — you confirm that you have read, understood, and agree to these Terms in full.

If you do not agree, please discontinue use of the platform immediately.

1. About SurveyMitra — Platform Role

1.1 What SurveyMitra Is

SurveyMitra is a technology aggregator platform that connects customers needing land surveying services with independent, third-party private surveyors operating in their area. We facilitate appointment booking, surveyor assignment, commission management, and invoice issuance.

1.2 What SurveyMitra Is NOT

SurveyMitra is NOT a land surveying agency, NOT a government body, and NOT an employer of surveyors.Surveyors on our platform are independent contractors, not employees or agents of SurveyMitra. The actual survey service contract is directly between the Customer and the Surveyor. SurveyMitra is not a party to this service contract.

1.3 Eligibility

• You must be at least 18 years of age
• You must have legal authority over or permission to survey the property in question
• You must have the legal capacity to enter into a binding contract under Indian law

2. Services Offered

SurveyMitra facilitates the following private land survey types:

• Agricultural Land Survey: Accurate measurement and demarcation of agricultural plots
• Plot / Boundary Survey: Identification and marking of residential or commercial plot boundaries
• Land Division Survey: Partition of land among multiple owners/heirs
• Other Survey Services: As agreed between customer and assigned surveyor

Survey reports are delivered by the surveyor based on field conditions and professional judgment. Report delivery timelines are at the surveyor's discretion and not guaranteed by SurveyMitra.

3. Customer Terms — Appointment Booking

3.1 Booking Process

• Customers submit an appointment form with property details, service type, preferred date, phone, and email
• A booking confirmation is sent via email and/or SMS once payment is verified
• An available surveyor in your tehsil/district is automatically assigned within 24–48 hours
• You will be notified when a surveyor is assigned

3.2 Customer Obligations

• Provide accurate property location (state, district, tehsil, village, pincode)
• Ensure physical access to the land is available on the survey date
• Be reachable on your registered phone number for surveyor coordination
• Inform us of any access restrictions (locked gates, disputes, government constraints) before booking
• Pay the surveyor's service fee directly in cash at the time of the site visit

3.3 Surveyor Assignment

Surveyor assignment is automatic, based on tehsil/district match and surveyor availability. SurveyMitra does not guarantee assignment of a specific surveyor. If auto-assignment fails (no available surveyor), an admin will manually assign or contact you.

3.4 Appointment Status Tracking

Your appointment progresses through the following stages:

• Lead Generated → Booking received, awaiting assignment
• Assigned → Surveyor has been assigned
• In Progress → Survey underway
• Completed → Survey done, commission pending
• Closed → Commission paid, case closed
• Overdue → Surveyor has not marked complete after 7 days (admin review)
• Cancelled → Appointment cancelled by admin

4. Payment Terms

4.1 Platform Booking Fee

• All prices displayed on surveymitra.com are in Indian Rupees (INR) inclusive of applicable taxes
• Payment is processed via Razorpay (UPI, Net Banking, Debit/Credit Card)
• Payment must be completed at the time of booking to confirm the appointment
• A payment confirmation and GST invoice is emailed to you upon successful transaction

4.2 Non-Refundable Policy

The platform booking fee is non-refundable once the booking is confirmed. See our full Cancellation & Refund Policy for details on rescheduling, duplicate charges, and exceptional circumstances.

5. Surveyor Account Terms

By registering as a surveyor on SurveyMitra, you agree to our separate Surveyor Registration Terms, which govern lead delivery, commission payments, account blocking, and invoicing.

Key obligations summary:

• You must visit the customer's site and perform the survey within 7 days of the scheduled date
• You must mark the appointment as complete in your dashboard after the survey
• You must pay ₹500 commission to SurveyMitra per completed appointment via Razorpay
• Failure to pay 2 or more commissions results in automatic account blocking (no new leads)
• A GST Tax Invoice is automatically emailed to you upon commission payment

6. Prohibited Conduct

You agree NOT to:

• Provide false property details or impersonate another person
• Use the platform to conduct illegal surveys or surveys on disputed/encroached land without disclosure
• Attempt to manipulate appointment status, commission records, or any backend data
• Reverse-engineer, scrape, or misuse the platform's API or data
• Circumvent surveyor blocking by creating multiple accounts
• Contact surveyors or customers obtained through the platform outside of the intended service relationship

7. Disclaimer of Liability

7.1 Survey Accuracy

SurveyMitra does not guarantee the legal admissibility, accuracy, or completeness of any survey report produced by an independent surveyor. The surveyor's professional judgment and methodology is their own. SurveyMitra is not responsible for survey errors or boundary disputes.

7.2 Surveyor Conduct

SurveyMitra is not liable for the conduct, actions, or professional standards of independent surveyors. Any grievance against a surveyor should be reported to us and escalated to the concerned professional body.

7.3 Force Majeure

SurveyMitra is not liable for failures or delays caused by events beyond our control: natural disasters, government restrictions, internet outages, payment gateway failures, pandemics, or acts of God.

7.4 Liability Cap

To the maximum extent permitted by Indian law, SurveyMitra's total liability to you for any claim shall not exceed the amount you actually paid for the specific booking giving rise to the claim.

8. Intellectual Property

All content on surveymitra.com — including the SurveyMitra name, logo, design, text, code, and graphics — is the exclusive property of SurveyMitra and protected under the Copyright Act, 1957 and applicable Indian IP law. No content may be reproduced, distributed, or used commercially without written permission.

9. Account Management

• You are responsible for the security of your login credentials
• Notify us immediately at contact@surveymitra.com if you suspect unauthorized account access
• We reserve the right to suspend or terminate accounts for any violation of these Terms
• Deleted accounts may be retained in anonymized form for audit and legal compliance purposes

10. Dispute Resolution & Governing Law

10.1 Informal Resolution (First Step)

All disputes must first be submitted in writing to contact@surveymitra.com. We will attempt to resolve the matter within 30 days.

10.2 Governing Law

These Terms shall be governed exclusively by the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019.

10.3 Jurisdiction

All disputes, legal actions, or proceedings arising from these Terms or the use of SurveyMitra shall be subject to the exclusive jurisdiction of the courts of Indore, Madhya Pradesh, India.You hereby waive any objection to this venue.

10.4 Arbitration

At SurveyMitra's election, any unresolved dispute may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Indore, Madhya Pradesh. The language of arbitration proceedings shall be Hindi or English.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes become effective upon posting with an updated date. Continued use of the platform after changes constitutes acceptance. For material changes, we will send an email notification to registered users.
