Welcome to SurveyMitra. These Terms and Conditions ("Terms") govern your use of our land surveying services and website. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, booking a survey appointment, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Services Description

SurveyMitra provides professional land surveying services including:

• Agricultural Land Survey
• Plot/Boundary Survey
• Land Division Survey
• Other Survey Services

Our platform connects customers with qualified and certified land surveyors in their area. We facilitate appointment booking, payment processing, and service delivery coordination.

3.1 Platform Role - Aggregator Only

SurveyMitra is a technology platform and aggregator. We are NOT a land surveying agency. We connect users with independent, third-party land surveyors. The contract for the actual survey service is directly between You (the User) and the Surveyor. SurveyMitra is not a party to this service contract.

3.2 Surveyor Discretion & Authority

The specific mechanism, equipment, or technical approach used for the survey is at the sole discretion of the independent Surveyor based on field conditions. The Surveyor's professional judgment is final.

3.3 Liability Waiver

To the fullest extent permitted by law, SurveyMitra disclaims all liability for:

• Any errors, omissions, or inaccuracies in the survey report provided by the independent Surveyor.
• Any property damage, personal injury, or accidents occurring during the site visit.
• The conduct, behavior, or negligence of the independent Surveyor.
• Disputes regarding property boundaries arising from the survey results.

Access to the platform is provided on an "AS IS" basis without warranties of any kind.

3. User Accounts

3.1 Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to create an account
• One person or entity may maintain only one account

3.2 Account Security

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Booking and Payments

4.1 Appointment Booking

• All bookings are subject to surveyor availability
• You must provide accurate property details and contact information
• Booking confirmation will be sent via email and SMS
• Appointments are assigned to qualified surveyors based on location and availability

4.2 Pricing and Payment

• All prices are displayed in Indian Rupees (INR) and include applicable taxes
• Payment must be made in full at the time of booking
• We accept payments through Razorpay (credit cards, debit cards, UPI, net banking)
• Payment confirmation will be sent to your registered email

4.3 Payment Security

All payments are processed securely through Razorpay, a PCI DSS compliant payment gateway. We do not store your complete card details on our servers.

5. Service Delivery

5.1 Survey Execution

• Surveyors will contact you to confirm the appointment and coordinate site access
• You must provide clear access to the property on the scheduled date
• Survey duration may vary based on property size and complexity
• Weather conditions or site accessibility issues may require rescheduling

5.2 Survey Reports

• Survey reports will be delivered within 7-10 business days after field work completion
• Reports are provided in digital format (PDF) via email
• Physical copies can be requested for an additional fee
• Reports include measurements, drawings, and surveyor certification

5.3 Service Standards

All surveys are conducted by qualified and certified surveyors following industry standards and best practices. We strive to provide accurate and reliable survey data.

6. User Responsibilities

As a user of SurveyMitra, you agree to:

• Provide accurate and complete information for all bookings
• Ensure property access and necessary permissions for survey work
• Treat surveyors with respect and professionalism
• Not use our services for any illegal or unauthorized purpose
• Not interfere with or disrupt our services or servers
• Comply with all applicable laws and regulations

7. Intellectual Property

All content on the SurveyMitra platform, including text, graphics, logos, images, and software, is the property of SurveyMitra or its licensors and is protected by Indian and international copyright laws.

Survey reports and data provided to you are for your personal use only. You may not reproduce, distribute, or create derivative works without our written permission.

8. Limitation of Liability

8.1 Service Limitations

While we strive to provide accurate and reliable surveying services, we cannot guarantee that surveys will be error-free or meet all your specific requirements. Survey accuracy may be affected by factors beyond our control.

8.2 Liability Cap

To the maximum extent permitted by law, our total liability for any claims arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim.

8.3 Exclusions

We are not liable for:

• Delays or failures due to circumstances beyond our control (force majeure)
• Inaccuracies in information provided by you
• Property disputes or legal issues arising from survey results
• Third-party actions or omissions
• Loss of data or business interruption

9. Indemnification

You agree to indemnify and hold harmless SurveyMitra, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Inaccurate information provided by you

10. Dispute Resolution

10.1 Informal Resolution

In the event of any dispute, we encourage you to contact us first at contact@surveymitra.com to seek an informal resolution.

10.2 Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any and all disputes arising out of or related to these Terms, the platform, or our services shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh.You hereby waive any objection to this venue.

10.3 Mandatory Arbitration

Any dispute not resolved informally shall be referred to a sole arbitrator appointed by SurveyMitra in Indore. The arbitration shall be conducted in English/Hindi under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Indore.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and SurveyMitra regarding our services.
